This document outlines our data protection obligations and your data protection rights under the Regulation (EUR) 2016/679 of the European Parliament and of the Council dated 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (the "GDPR"), as implemented or complemented by the applicable national law (together with the GDPR, the "Data Protection Laws").
In this document, "we", "us" and "our" refer to BoldMind Capital Partners BV and/or its affiliates and delegates.
The terms "personal data", "controller", "processor", "processing" and other data protection terms in this document are to be understood as defined in the GDPR.
You understand that by virtue of contacting us on the website www.boldmindcapital .com trough the contact form or by virtue of visiting our site, you will provide us with certain personal information which constitutes personal data. This includes, but is not restricted to, data such as your name, email address, phone number and data automatically collected and stored in the so-called server records, which the browser used by the user transmits to us automatically. This information cannot be linked to a specific person individually. Also, we do not associate the collected data with information from other sources. However, we reserve the right to review the information, subsequently, if a suspicion of illegal or unauthorized use is brought to our attention
In our use of this personal data, we will be characterised as a "data controller" under the GDPR. Our affiliates and delegates, including but not limited to the Domiciliation Agent, may act as "data processors" under the GDPR.
You understand that we may collect, store and use this data for lawful purposes including, in particular where this is necessary for the purposes of the legitimate interests of us or a third party and such legitimate interests are not overridden by your interests, fundamental rights or freedoms.
Analysing personal data for quality control, business and statistical analysis, protecting security and managing access to IT and communication systems, the website and other systems, are also legitimate interests for using your personal data.
Accordingly, you understand that we may use your personal data for such purposes as described above, provided that we are acting in a fair, transparent and accountable manner and have taken appropriate steps to prevent such activity having any unwarranted impact on you and also noting your right to object to such use, as discussed below.
Given the specific purposes for which we envisage using your personal data, under the provisions of the GDPR, we do not anticipate being required to obtain your consent to do so. Should we wish to use your personal data for other specific purposes that require your consent, we will contact you to request this.
We may share your personal data with courts, law enforcement authorities, regulatory authorities or lawyers or other persons if it proves to be justly necessary in order to ascertain, exercise or defend a legal right. We can also share your personal data with authorized companies - mainly service providers (providers for various services, such as website administration and hosting services) in order to process personal data for the purposes mentioned above, on our behalf and only in accordance with our instructions.
Any transmission of personal data by us or our duly authorised delegates outside the EEA shall be in accordance with the conditions in the GDPR.
We and our duly authorised delegates shall apply appropriate information security measures designed to protect data in our/our delegates" possession from unauthorised access by third parties or any form of computer corruption.
We shall notify you of any personal data breach affecting you that is likely to result in a high risk to your rights and freedoms.
You understand that you have certain rights regarding our use of your personal data such as:
- the right to access your personal data (in an easily readable form);
- the right to examine and correct your personal data;
- the right to restrict the use of your personal data;
- the right to withdraw any consent given to the processing of your personal data (where applicable);
- the right to receive information regarding any entities we disclose your personal data to; and
- the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).
You also have the right to object to the processing of your data where we have considered this to be necessary for the purposes of our legitimate interests.
We or our duly authorised delegates may retain your personal data for a period of up to three years following the collecting date.
