Basic information on the processing of personal data

Data controller

The controller of your personal data is BOLDMIND CAPITAL PARTNERS BV, having its headquarters in Prinses Margrietplantsoen 33,' s-Gravenhage, the Netherlands, registered with the Trade Register at the Chamber of Commerce of the Netherlands with registration number 93836856 (hereinafter BOLDMIND).

Processed data

The following information is required for the recruitment process: Surname/first name; date of birth; domicile address; telephone number; e-mail address; education; qualifications; certificates; professional experience; foreign languages; IT skills / AI tools proficiency. Any additional data you share with us will be deleted to the extent possible.

During the recruitment process and during interviews, we may also receive information directly from you, including salary expectations, availability and any other information you choose to share. References from former employers will only be obtained based on your explicit prior consent (Art. 6(1)(a) GDPR); you may withdraw this consent at any time without affecting the lawfulness of processing carried out before withdrawal.

If you send us your CV spontaneously (without a specific job posting), your data will be processed in the same manner as described in this notice.

Purposes and legal basis of processing

The purpose of the processing of your data is:

  • To conduct the current recruitment processes for open positions within BOLDMIND and to assess whether your professional experience and theoretical knowledge match the position you applied for. Identifying candidates who meet the necessary profile for the open position is essential for concluding an individual employment contract
  • Your email address is used to send you an offer
  • If you are selected and accept BOLDMIND's offer, your phone number and email address will be used to contact you for completing the formalities required for signing the individual employment contract.

The legal basis for the processing of your personal data is:

  • Art. 6(1)(b) GDPR – processing necessary for the performance of pre-contractual measures taken at your request (assessment of your candidacy for the purposes of concluding an employment contract)..
  • Art. 6(1)(f) GDPR – legitimate interest of BOLDMIND, consisting in the ability to identify and contact suitable candidates for vacant positions within the organisation, including retaining relevant candidate profiles for a period of up to 6 months following the conclusion of the recruitment process (see Data retention period below).

Data retention period

Your personal data will be retained for a period of 4 (four) weeks after the completion of the recruitment process for the position you applied for, after which they will be securely and permanently deleted.

Exception – candidates with a relevant profile: if BOLDMIND considers your profile relevant for potential future openings, your data may be retained for up to 6 months from the conclusion of the recruitment process, on the basis of BOLDMIND's legitimate interest (Art. 6(1)(f) GDPR). You will be informed of this at the time of rejection and you have the right to object at any time (see Rights below). Upon objection, your data will be immediately and permanently deleted.

Data recipients

As a rule, BOLDMIND will not share your personal data with third parties.
In the event that recruitment services are provided by an authorised processor (recruitment agency), such processor will have access to your data solely for the purpose of conducting the recruitment process on behalf of BOLDMIND, under a data processing agreement compliant with Art. 28 GDPR.

Rights of the data subject

You have the following rights in relation to your personal data processed by BOLDMIND:

• Right of access (Art. 15) – to obtain confirmation of whether your data is being processed and to receive a free copy of such data;
• Right to rectification (Art. 16) – to have inaccurate or incomplete data corrected;
• Right to erasure (Art. 17) – to request deletion of your data where it is no longer necessary for the purposes for which it was collected;
• Right to restriction of processing (Art. 18) – to request that processing be limited in certain circumstances;
• Right to data portability (Art. 20) – to receive your data in a structured, commonly used and machine-readable format, where technically feasible;
• Right to object (Art. 21) – to object at any time to processing based on BOLDMIND's legitimate interest, including the retention of your data for 6 months after the conclusion of the recruitment process. Upon such objection, BOLDMIND will immediately cease processing and permanently delete your data;
• Right to lodge a complaint (Art. 77) – with the competent supervisory authority: Autoriteit Persoonsgegevens (info@autoriteitpersoonsgegevens.nl).

All requests may be submitted in writing to: office@boldmindcapital.com.
BOLDMIND will respond within 30 calendar days.

Data transfers to a third country (outside the EEA)

Your personal data will not be transferred outside the European Economic Area. In the event that any transfer outside the EEA becomes necessary, you will be informed separately and any such transfer will be based on appropriate legal safeguards, including the standard contractual clauses approved by the European Commission.

Automated decision-making, including profiling

BOLDMIND will not make automated decisions, including profiling for the purpose of automated decision-making, in the processing of your personal data.

Obligation to provide data and consequences of failure to do so

The provision of personal data for participation in a recruitment process is voluntary but necessary for your selection, the submission of a job offer, and the conclusion of an individual employment contract. Refusal to provide the required data will make it impossible to include you in the recruitment process, as it will not be possible to verify whether the professional experience and qualifications required for the position are met.
